Ban on unauthorized GPS tracking in Virginia

A bill has been passed in Richmond, Virginia by a House of Delegates, banning the unauthorized use of GPS technology or other similar tracking devices. The bill, which was introduced by delegate Joe May, spoke about prohibiting the use of GPS to track a persons location, deceptively and without prior consent.

May, a member of the Republican Party, introduced the said bill after one of his constituents requested him to do so upon learning that his estranged wife had hired a private investigator to keep track of his whereabouts by placing a GPS device on his car. The bill was then recommended by the Joint Commission on Technology and Science of Virginia as well.

Though, not everyone will be affected by the implications of this bill. Law enforcement officers can still use GPS to track suspects, on the condition that they obtain a warrant beforehand. Also exempts are the parents who want to track their kids, owners of fleet vehicles, legally authorized representatives of incapacitated adults as well as electronic security and communication providers such as OnStar and all cell phone companies.

Having been in the pipeline for nearly two years, the passing of the bill has proven to be a popular decision amongst many Virginia residents who had voiced their concerns about how GPS tracking is a deterrent to a persons privacy. But, it must be pointed out that not everyone is quite so happy with the bill.

Private investigators are particularly displeased, since using GPS device to track people is a major part of their work. Private investigators and their representatives vehemently opposed this bill, claiming that they work a number of important cases which require them to avail GPS technology.
